About these terms
These terms are an agreement between you and [Legal name of the company or person who sells FileX] ("FileX", "we", "us"), the maker of the FileX app for macOS and Windows and of this website. By creating an account, installing FileX or buying a license, you accept them. If you do not accept them, please do not use FileX.
The short version. FileX converts your files on your own computer. You get a 7-day free trial, then you can buy a one-time lifetime license. Your files are never uploaded to us. Don't share your account or your license key, and don't use FileX to break the law. Everything below explains this properly.
Your account
You need an account to use FileX. To create one you must be at least 16 years old and give us a working e-mail address, which you confirm by opening the link we send you.
- Keep your password secret. You are responsible for what happens under your account.
- An account is for one person. Please don't share it with others.
- Tell us at once if you think someone else has used your account.
The 7-day free trial
Every new account starts with a free trial of 7 days, counted from the moment the account is created. During the trial FileX works in full and no payment details are needed. The trial is for one person: creating further accounts to get more trial time is not allowed, and we may end trials we believe are being abused.
When the trial ends, FileX stops converting until you buy a license or enter a license key. Your settings, presets and watch folders are kept.
The lifetime license
When you buy a lifetime license, we give you a personal, non-exclusive, non-transferable right to use FileX on computers that you own or control, signed in to your account. It includes the updates we release for FileX. We may offer separate products or paid editions, which are not part of your license.
"Lifetime" means for as long as we offer FileX, not for the length of your life. If we ever stop offering FileX, we will tell you at least [notice period, for example 90 days] before and keep the app working during that time.
Your license belongs to your account. Signing in on another computer with the same e-mail and password activates FileX there. We also e-mail you a license key after you pay, and show it on the Account page in the app. A license key can belong to one account only.
Prices and payment
The price is shown at checkout before you pay, and it is a one-time payment. A launch price may be offered to a limited number of buyers; it ends when that number of licenses has been sold, and a refunded license makes its place available again. Taxes such as VAT or sales tax may be added where the law requires it. Payments are processed by our payment provider, Dodo Payments. You pay on their secure page and they send you the receipt. We never see or store your card details.
Refunds
[Describe your refund policy here. For example: If FileX does not work for you, ask for a refund within 14 days of buying and we will refund the full price.] To ask for a refund, write to [support e-mail address] with the e-mail address you used to buy.
When a payment is refunded, or when a payment is reversed by a chargeback or dispute that is decided against us, the license for that payment ends and FileX goes back to asking for a license.
Nothing in this section limits rights you have under consumer protection law, such as a statutory right to withdraw from a distance purchase.
Your files
FileX converts files on your computer. We do not receive, open or store the files you convert, or their names. You are responsible for the files you convert:
- You must have the right to convert them.
- Conversion can change a file or lose detail. Keep your originals and back up what matters.
- Files protected by encryption or copy protection (DRM) cannot be converted.
Using FileX properly
You agree not to:
- share, sell or publish your account or license key, or use someone else's;
- get around the trial or the license check;
- copy, reverse engineer, decompile or modify FileX, except where the law gives you that right regardless of this agreement;
- use FileX to break the law or someone else's rights, or to attack or overload our services.
Open-source software
FileX includes open-source software. Those parts stay under their own licenses, which are listed in the app (Account, then About, then notices). Nothing in these terms limits the rights those licenses give you.
Updates and availability
FileX needs the internet to create an account, sign in and check your license. After that it works offline and remembers your license, and it checks again whenever it is online. We may update, change or remove features, and our services may sometimes be unavailable. We will try to keep that to a minimum, but we do not promise uninterrupted service.
Ending your use
You can stop using FileX at any time and ask us to delete your account (see the Privacy Policy). We can suspend or close an account that breaks these terms. If we close your account for a reason other than your breach, we will refund what you paid.
No warranty
FileX is provided "as is". To the extent the law allows, we do not promise that it is free of errors, that every conversion is perfect, or that it fits a particular purpose. You may have rights under consumer law that we cannot take away; these terms do not affect them.
Limits on liability
To the extent the law allows, we are not liable for indirect or consequential losses, lost profit, or lost data. Our total liability for any claim about FileX is limited to the amount you paid us in the 12 months before the claim. None of this excludes liability that cannot be excluded by law, such as for death or personal injury caused by negligence, or for fraud.
Changes to these terms
We may update these terms, for example when FileX changes. We will tell you in the app or by e-mail before important changes take effect. If you keep using FileX after that, you accept the new terms. If you do not agree, you can stop using FileX.
Governing law
These terms are governed by the laws of [country or state], and the courts there can decide disputes, except where the law of your country gives you the right to go to court at home or protects you in another way.
